At that time, no utility for the license was made because none was needed.
However, the commerce department didnt respond to a request for comment.
Defendants have neither made a licensing determination for the equipment nor even indicated when the decision will be made.
The lawsuit also names the Office of Export Enforcement and Bureau of Industry.
